Online gaming

Game developers, publishers and gaming platforms.

In short

Before launch, every game feature that involves money needs checking against the 2025 Act, and any game young players use needs a plan for their data.

The Promotion and Regulation of Online Gaming Act, 2025 changed the legal position for gaming businesses in India. It supports e-sports and online social games, and prohibits online money games, together with advertising them and processing payments for them.

The first question for any gaming business is which category its games fall into. Entry fees, cash prizes, exchangeable virtual currencies and rewards linked to deposits can all affect the answer, so each feature needs to be assessed on its own terms.

Gaming platforms also attract young users. That brings in the DPDP Act's rules on children's data, which require verifiable parental consent, as well as user terms covering virtual items, in-game purchases and account suspension.

What usually comes up

Under the DPDP Act

Online gaming intermediaries with at least fifty lakh registered users in India must erase inactive users' data after three years, and tell each user at least 48 hours before doing so.
